California men sentenced for alleged beef truck theft

A California defendant who was charged with attempting to steal $88,000 worth of commercial property in Kansas has been sentenced. The man received a sentence of a year and a day in federal custody, and he will also serve two years' time on the supervised release rolls. The man was accused of conspiracy to commit interstate shipment fraud - a form of theft. His brother, who was also involved in the incident, was convicted of felony counts for lying to authorities. He received a probationary sentence of a single year.

Attorneys say that the brothers were caught by a freight broker out of the Midwest as they were allegedly attempting to perpetrate a theft scheme. The brothers stole the identity of a trucking company in order to obtain freight contracts. Then, they reportedly attempted to make off with a truckload of beef that was being transported through Kansas through theft by fraud.

It appears that the men may have stolen identity documents from a freight hauler in Pennsylvania. They were ultimately unmasked by an Ohio broker who contacted the FBI about inconsistencies in the brothers' trucking insurance. The FBI kept the men under surveillance after working with the broker to award a hauling contract to the defendants. The defendants were caught when they then attempted to make off with the load, even though they were not actually representatives of a legitimate trucking firm.

Interestingly, the judge in the case will allow the first defendant to continue to use medical marijuana while he serves his two-year supervised release in California. That is an unusually lenient provision. Judges and attorneys should be committed to protecting defendants' rights, no matter what types of penalties they are facing.
